Terms of Use

These Terms of Use ("Terms") govern your access to and use of the Services operated by Deepsky Pty Ltd ABN 86 683 512 183 ("Deepsky", "we", "us", "our"). By accessing or using the Services, you agree to be bound by these Terms. If you do not agree, do not use the Services.
If you use the Services on behalf of an organisation, you represent and warrant that you have authority to bind that organisation to these Terms.
1. The Services
Deepsky provides AI-powered tools and information services related to aviation operations. We may change, update, suspend, or discontinue features of the Services at any time. Where practicable, we will provide reasonable notice of material changes. We do not guarantee that the Services will be uninterrupted, error-free, or available at all times.
2. Accounts
To use certain features of the Services, you must create an account. You agree to:
- Provide accurate and complete registration information
- Keep your login credentials secure and confidential
- Notify us promptly at admin@deepskyai.com if you suspect unauthorised access to your account
You are responsible for all activity that occurs under your account.
3. Acceptable use
You agree not to:
- Use the Services in any way that violates any applicable Australian or international law, regulation, or third-party rights
- Attempt to gain unauthorised access to systems, networks, data, or other user accounts
- Interfere with, disrupt, or place an unreasonable load on the Services or their infrastructure
- Use the Services to distribute malware, spam, or harmful content
- Scrape, mine, or use automated means to access the Services in a way that exceeds normal use or bypasses rate limits
- Reverse engineer, decompile, or disassemble any part of the Services, except to the extent expressly permitted by Australian law
- Impersonate any person or entity, or misrepresent your affiliation with any person or entity
We may suspend or terminate your access without notice if you breach these Terms.
4. Your content
You retain ownership of any content you submit through the Services ("Your Content"). By submitting content, you grant Deepsky a non-exclusive, worldwide, royalty-free licence to host, store, process, transmit, and display Your Content as reasonably necessary to provide and improve the Services. This licence ends when you delete Your Content or your account, except where we are required by law to retain it.
You represent and warrant that you have all rights necessary to submit Your Content and that it does not infringe the rights of any third party or violate any law.
5. Analytics and service improvement
We analyse usage patterns and conversation data to understand user needs and improve the Services, as described in our Privacy Policy. We do not share your personal information or conversation content with third parties.
6. Aviation and professional use disclaimer
The Services may provide information related to aviation, NOTAMs, regulations, meteorology, or flight operations. This information is provided for general informational and situational awareness purposes only.
- Output from the Services does not constitute professional advice and does not replace official aeronautical publications (AIP, NOTAMs, NOTAM summaries), operator-approved procedures, regulatory requirements, or professional judgement
- You are solely responsible for verifying all information against official sources before relying on it for any operational decision
- Deepsky is not a certified aviation information provider and the Services are not approved for use as a primary source of aeronautical information
You remain fully responsible for compliance with all applicable aviation regulations, your operator's requirements, and the exercise of proper aeronautical decision-making.
7. Intellectual property
The Services, including all software, branding, design, text, graphics, and underlying technology, are owned by Deepsky or its licensors and are protected by Australian and international intellectual property laws. These Terms grant you a limited, non-exclusive, non-transferable, revocable licence to use the Services for their intended purpose. No other rights are granted.
8. Third-party services
The Services may link to or integrate with third-party services or content. We do not control and are not responsible for third-party services. Your use of any third-party service is governed by that service's own terms and privacy practices.
9. Disclaimers
To the maximum extent permitted by law, the Services are provided "as is" and "as available" without warranties of any kind, whether express, implied, or statutory, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
Nothing in these Terms excludes, restricts, or modifies any consumer guarantee, right, or remedy conferred by the Competition and Consumer Act 2010 (Cth) or any other applicable Australian consumer protection law that cannot be excluded, restricted, or modified by agreement.
10. Limitation of liability
To the maximum extent permitted by Australian law:
- Deepsky is not liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or goodwill arising out of or in connection with your use of the Services
- Our total aggregate liability for all claims arising out of or relating to these Terms or the Services is limited to the greater of: (a) the total fees you have paid to Deepsky in the twelve (12) months immediately preceding the claim, or (b) AUD $100
This limitation of liability does not apply to the extent prohibited by law, including under the Australian Consumer Law.
11. Indemnity
To the extent permitted by law, you agree to indemnify and hold harmless Deepsky, its officers, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in connection with: (a) Your Content, (b) your use of the Services in breach of these Terms, or (c) your violation of any law or third-party rights.
12. Termination
You may stop using the Services and close your account at any time. To request deletion of your data, email admin@deepskyai.com.
We may suspend or terminate your access to the Services at any time if you breach these Terms, or for operational or legal reasons with reasonable notice where practicable.
Upon termination, your right to use the Services ceases immediately. Sections of these Terms that by their nature should survive termination will survive, including disclaimers, limitations of liability, indemnity, and governing law.
13. Governing law and jurisdiction
These Terms are governed by and construed in accordance with the laws of Queensland, Australia. The courts of Queensland have exclusive jurisdiction in relation to any dispute arising out of or in connection with these Terms, subject to any mandatory consumer protection provisions that may confer jurisdiction on other courts.
14. Severability
If any provision of these Terms is found to be invalid or unenforceable, that provision will be severed to the minimum extent necessary and the remaining provisions will continue in full force and effect.
15. Entire agreement
These Terms, together with the Privacy Policy, constitute the entire agreement between you and Deepsky regarding your use of the Services and supersede all prior agreements and understandings.
16. Changes to these Terms
We may update these Terms from time to time. We will post the revised Terms on our website and update the "Last updated" date above. Where changes are material, we will take reasonable steps to notify you. Your continued use of the Services after updated Terms take effect constitutes your acceptance of those changes.
